Installing a residential pool or large spa often involves getting council approval. You might need Resource Consent, which is based on your property’s specifics, like how close the pool is to boundaries, according to local planning rules (such as the Unitary Plan). You may also need Building Consent, which relates to the construction standards and safety aspects of the pool and its barrier.
You generally won’t need a Building Consent for the pool structure itself if it’s in-ground or sits directly on the ground with a capacity under 35,000 litres. For above-ground pools, exemptions depend on specific height and volume limits. However, any pool deeper than 400mm requires a safety barrier. Getting Building Consent for this barrier is always required. Depending on the pool design (e.g., high, non-climbable sides), the barrier might just secure the access points, but most situations will need a full fence around the pool area.
A fixed-fee process for the barrier’s Building Consent is available if you’re installing a standard portable pool that meets certain criteria (like size, simple fencing, and site conditions). If your pool project involves a deck, you’re responsible for making sure the deck can support the weight; significant alterations to decks over 1.5 metres high might also require consent. It’s always best practice to consult with the council beforehand, using their free advice sessions or pre-application meetings, to clarify the exact approvals needed for your specific situation.
